Hunkered Down in Bremerton

Trump's Lawyer's Got It Right

The Republicans may well not vote to convict Trump this weekend, however the Moe, Larry and Curly... No I mean Bruce Castor ,David Schoen and Michael T. van der Veen were correct when they said that this case should be heard in the legal system not the political system. There you have it...Monty Wilkinson ... Acting Attorney General.

William Barr, when he was Attorney General, said that the Justice Department couldn't indict a sitting president. Well they can damn well indict a past president for sedition for his actions that created the insurrection that took place at the Capitol on January 6. 2021.

After the upcoming acquital this weekend, Trump's people will cry "Double Jeopardy" if he is indicted. However the double jeopardy concept only applies for additional trials within the same jurisdiction. As Trump's attorneys pointed out, the Senate is a polictical justdiction whereas the Justice Deparment is a legal jurisdiction. They are different jurisdictions. Double Jeopardy will not apply... Trump can be acquited in the Senate and still be tried in the federal court system.

I doubt that a conviction in federal court will prevent Trump from running for president again, however a couple of years at Guantanamo Bay may change his chances.

A conviction on sedition charges will also not prevent additional legal action against Trump for obstruction of justice and tax fraud in federal courts. Nor will it free him from defending himself in New York state courts for tax fraud, nor in Georgia for election tampering. All of the women who are accusing him of some kind of sexual assault will still be free to pursue these avenues of justice also.

Whatever happens in the Senate, Trump is not free from considerable legal challenges over the next few years. He will have to pay millions in legal fees and spend many days doing some kind of "perp walk" in front of TV Cameras into courthouses. This holds true even if he is acquitted in many of the future trials.
