Cuomo and Trump

This week New York Governor Andrew Cuomo has been accused of sexually harassing eleven women in a scathing report issued by New York Attorney General Letitia James. His reponse has been similar to and as feeble as had former President Trump's responses to allegations of sexual misconduct

In a legal sense, sexual harassment isn't a criminal offense. This is a matter to be handled in civil courts, just as are Trump's alleged sexual misconducts. Cuomo may have to answer to criminal charges if it can be proven that he retaliated against any of the eleven women after their accusations.

In both cases the accused, Cuomo and Trump, don't have a clue that what the did was wrong. They both claim that it was not their intention to do anything inappropriate. Their actions were friendly in manner, there was no hostile intent. They both thought that all of the women involved were enjoying the encounters. They are both taken aback that these women actually felt otherwise. They didn't have a clue.

Sexual harassment is never considered from the point-of-view of the accused harasser. Intent is of no importance. Sexual harassment is only considered from the point-of-view of the harassed, or third parties. If in the view of any of the eleven women involved in this investigation that provable actions by the accused were sexual harassment then sexual harassment hss taken place. The only defense is that the actions did not take place.

Third parties who view or hear situations of what they consider to be sexual harassment are also covered. The only defense, once again, is that the actions did not take place.

While these actions may not have been criminal nature there is plenty of cause for civil action.

Governor Cuomo it is up to you resign with some dignity and accept you fate. Otherwise you should be impeached and removed from office.
